如果你有家人患有認知障礙、中風、阿滋海默症或因各種原因而精神上無行為能力替自己的個人事務、財務、醫療及牙科治療事宜作決定，你可以為該名家屬申請監護令。根據《精神健康條例》，監護委員會為監護令的申請舉行聆訊。

監護委員會在處理申請時會考慮以下因素來判斷當事人是否精神無行為能力。
該精神上無行為能力人士的精神紊亂或弱智的性質或程度，是否足以構成理由，將他/她收容監護；
 有關的精神紊亂或弱智，是否限制該精神上無行為能力人士，就與其個人情況有關的所有或佔相當比例的事宜，作出合理的決定；
 該精神上無行為能力人士的特定需要，是否只有在其獲收容監護的情況下，方可獲得滿足及照顧，且在有關的情況下沒有其他較少限制或侵擾的方法可用；及
 為該精神上無行為能力人士的福利或為保護他人着想，他/她應該獲得收容監護。

申請人須向監護委員會提交兩份醫療報告，其中一份為符合資格的精神科醫生對當事人是否精神上無行為能力的評核，而精神科醫生有可能要求當事人作數次評估來作出評核。

如果監護令獲批，現時申請人最多每月由當事人提取港幣$17,700 (金額按年調整) 。社會福利署負責監督監護人的法定責任，例如要求監護人每月提交財政報告。大家申請監護令前最好與全部家人商量，以免日後有任何爭議。

Guardianship order application

If you have family member aged 18 or above who is mentally incapacitated, for example, as a result of elderly dementia, stroke, Alzheimer’s disease, you can apply for guardianship to help the incapable person to make their own decisions about their personal affairs, financial matters or medical/dental treatment. According to the Mental Health Ordinance (Cap.136), the Guardianship Board will conduct hearings to grant guardianship orders.

The Board will consider the following criteria in determining whether to grant guardianship or not:
 whether the mentally incapacitated person has a mental disorder or mental handicap of a nature or degree which warrants guardianship;
 whether the mental disorder or handicap limits the individual in making reasonable decisions in respect of all or a substantial proportion of the matters which relate to his/her personal circumstances;
 whether the individual’s particular needs may only be met or attended to by guardianship and that no other less restrictive or intrusive means are available in the circumstances; and
 that it is in the interest of the individual’s welfare or for protection of others that a guardian be appointed.

Applicants must prepare medical reports with one of the medical reports prepared by an “approved” doctor with special experience in the diagnosis or treatment of mental disorder, namely a psychiatrist.

If the application is successful, the applicant will receive an amount up to HK$17,700 (2020 figures). The Social Welfare Department will oversee the guardian, for example, requiring the guardian to submit a monthly financial report.
