知會備忘錄 Caveat

 何鴻燊的二房長女何超瓊近日向遺產承辦處呈交知會備忘錄以申明她在遺產中的權利。這份知會備忘錄的作用在於任何人展開何鴻燊的遺產程序前必須有知會她，何超瓊得到知會後有權在法庭上提出疑問並展開爭產程序。

Pansy Ho Chiu-king, daughter of the late Macau casino magnate Stanley Ho Hung-sun has filed a Caveat at the Probate Registry to take High Court action to register an interest in the handling of his will. The reason for her to file a caveat is to be notified whenever there is a grant to administer her father’s estate. She will have a right to bring questions before the court as a party interested to bring a probate action.

According to rule 44 of the Non-Contentious Probate Rules (Cap.10A), a party interested may enter a caveat if there is no grant yet for administering the estate of the deceased. The caveat will be effective for 6 months which can be extended on application. During the period which the caveat is effective, the caveator may be served warning if any person applies to grant wishes to dispose the caveat. Therefore, it is a useful tool to reserve your right in an estate.
