什麼是婚姻資產?
婚姻資產一般是指雙方在婚前及婚後的全部資產，但遺產和饋贈等資產可成為例外。

離婚時如何分配資產?
法庭鼓勵雙方就婚姻資產分配達成共識。這樣可節省時間和法律開支，達致雙嬴局面。倘若雙方未能達成共識，法官會先滿足各方的經濟需要。如果資產超出經濟需要，法官會先應用LKW v DD [2010] HKCFA 70的原則平均分配資產。

香港法例第192條《婚姻法律程序與財產條例》第7條例出分配資產時需考慮的因素。法官會考慮這些因素決定應否平均分配資產，例如婚姻維持了多久和各方在這段婚姻付出了多少。WLK v TMC (2010) 13 HKCFAR 618這宗離婚案就是個例子。這是一段只短暫、沒有子女的婚姻，但是雙方由在英國讀大學時認識輾輾轉轉離離合合維持了好一段長時間。女方於婚後放棄了當鋼琴家的夢想，聽從丈夫的話，陪伴他出差、平日陪伴他的家人生活。因此法官考慮到雙方的關係和女方為家庭的付出，判予她在經濟需要上的金額額外多5%。因此可見，法庭會在離婚案中考慮多方面的因素分配婚姻資產。歡迎致電或WhatsApp 69776708 林先生查詢報價及預約。

What is matrimonial asset?
Matrimonial asset refers to all assets of the parties to the marriage whether they are acquired before or after marriage with possible exceptions to inheritance and gift.

How to allocate your assets when divorce?
The court encourages the parties to settle their matrimonial assets when they divorce. This would be beneficial to the parties to avoid extra legal costs and time. However, when the parties cannot come to a consent, the court will first consider the financial needs of the parties. If there is any surplus, the starting point will be 50/50 applying the sharing principle laid down in LKW v DD [2010] HKCFA 70.

The court will then consider whether there is any good reason to depart the sharing principle under s.7 of the Matrimonial Proceedings and Properties Ordinance (MPPO) (Cap.192) before deciding the outcome. For example, the court will consider the duration of marriage and the contributions by the parties. In WLK v TMC (2010) 13 HKCFAR 618, the court regarded the marriage as short and childless although the parties started a long-term on-and-off relationship which started when they were in universities in the UK. However, the court recognized the wife’s contribution in giving up a career as a pianist and to compile with her husband’s wishes to travel with him and keep his family company, awarding the wife an extra 5% of the total assets on top of her needs-based award. Therefore, the court will consider all aspects of the case in allocating asset in divorce.
