虛假陳述

 最近一名公屋住戶因明知而在入息及資產申報表上作出虛假陳述,被控違反了香港法例第283章 《房屋條例》第26(1)(c) 條,判監一個月(緩刑12個月)。被告在2017年入住公屋單位時聲稱沒有任何物業及沒有超出資產淨值限額。但是經房屋署調查後發現,被告早於2000年已經與他人共同擁有紅磡海逸豪園的住宅物業。該單位現在市值港幣一千七百萬元,扣除未還清的債務,被告佔有大概港幣四百萬元,遠超於公屋單身長者住戶2015/6 的$472,000元及2016/7的$484,000元的總資產淨值限額。

A public housing tenant was charged with false statement contrary to s.26(1)(c) of the Housing ordinance (Cap.283) recently for making false declarations during the application for public housing to the Housing Authorities. The Housing Authority on subsequent investigations, found out that the accused co-owned an apartment in Laguna Verde in Hung Hom, which has a market value of about HK$17 million, before his application for public housing. The accused therefore, after deducting unpaid mortgage, possesses around HK$4 million of assets, which is exceeds far beyond the net asset limits of HK$472,000 and HK$484,000 for an elderly singleton of public housing unit in the year 2015-16 and 2016-17, the time which the applicant made the false declarations, respectively. The accused was sentenced to one month of imprisonment which was suspended for 12 months.

Tenants or applicants of public housing who knowingly make a false statement or neglect to provide the information specified in the declaration form will be prosecuted under the Ordinance. A convicted person shall be liable to a maximum fine of HK$50,000 and six months’ of imprisonment. The application of the accused will be cancelled and any units assigned will be recovered by the Housing Department.
