近年興起在外地舉行婚禮並注册結婚，可是海外注册結婚可能產生婚姻不受香港法律承認的問題。當關係破裂時，他們香港未必有司法管轄權辦理海外注册的婚姻。

根據香港法例第 179章 《婚姻訴訟條例》第 3條，結婚的地點並不影響當事人在香港辦理離婚。只要符合以下原則，香港法院便享有就該離婚案的司法管轄權。
(a)在呈請或申請提出當日，婚姻的任何一方以香港為居籍；
(b)在緊接呈請或申請提出當日之前的整段3年期間內，婚姻的任何一方慣常居於香港；或
(c)在呈請或申請提出當日，婚姻的任何一方與香港有密切聯繫。

海外注册結婚可能出現的問題是當事人在外地舉行婚禮時沒有根據當地法律的要求注册結婚，也沒有在香港按照法律注册。當事人在香港辦理離婚時才發現當時只舉行”儀式上的婚禮”而沒有進行任何法律認可的結婚程序。香港法院可以辦理的是與同居伴侶一樣處理撫養權和頒佈有限的經濟濟助，當事人未能得到婚姻在法律上如資產分配的起點為 50/50的保障。因此，大家在選擇海外注册結婚前應先了解當地注册的要求，以免發生上述情況。

Divorce in Hong Kong of Overseas marriages

Some people choose to hold weddings and get married abroad in a wedding trip, however, problems may arise as to whether they can apply a divorce in Hong Kong if relationship breaks down.

According to s.3 of the Matrimonial Causes Ordinance (Cap. 179), couples can lodge a divorce in Hong Kong regardless of the place of marriage, as long as they satisfy the three requirements:
(a) either of the parties was domiciled in Hong Kong at the time of the petition
(b) either of the parties was habitual resident in Hong Kong throughout the period of three years immediately preceding the date of petition
(c) either of the parties had a substantial connection with Hong Kong at the date of the petition.

However, in some cases, parties to the divorce may not be able to lodge a divorce in Hong Kong because they have neither properly registered their marriage abroad nor in Hong Kong. It is therefore important for couples to check carefully with the local authorities for requirements to register a marriage if they decide to marry abroad. Otherwise, they would have held a “customary wedding” but not one with legal effect. They will be in no better position than cohabitating couples to enjoy the protection of marriage to divide the assets 50/50 as a starting point when they file a divorce in Hong Kong.
