根據香港法例第57章 《僱傭條例》,僱員可在勞資審裁處追討有關被無理或非法解僱的賠償。

近日,屯門興德學校前校長陳章萍因「影子學生」的醜聞被學校解僱。她被指虛報學生資料以換取政府資助,事件作刑事案處理。前校長現指控學校無理解僱,並追討被無理解僱後的薪金及代通知金。她同時打算追討因醜聞被廣泛流傳而導致她無法找到工作的損失。

根據《僱傭條例》第32K條,如果僱員受聘於連續性合約不少於24個月,僱員可因僱主沒有合理原因解僱在勞資審裁處向僱主追究責任。勞資審裁處的補救措施包括根據第32N條的復職命令或根據第32O條的終止僱員金。合理解僱的原因包括僱員的行為如經常性遲到、泄露公司機密等。一般而言,除非僱員處於試用期,僱主須給予僱員至少一個月通知或發放代通知金來解僱員工。解僱員工時,僱主須付清所有薪金(包括有薪假期的工資)及所有合約上訂明的應繳付金額。

What if I am unreasonably dismissed by my employer?

Employees are eligible to claim unreasonable and/or unlawful dismissal under the Employment Ordinance (Cap.57) (EO) in the Labour Tribunal.

Recently, an ex-principal Ms. Chan in the Tuen Mun Hing Tak School was fired for keeping “shadow students” who never turned up to class to maintain the school’s level of government funding. While the accusation was undergoing criminal procedures, Ms. Chan alleged the school for unreasonable dismissal and violating the notice requirement for dismissal. She was seeking to retrieve her lost salaries and termination payment as well as lost job opportunities because the incident was widely spread in the news.

Under s.32K of the EO, if an employee which has been employed under a continuous contract of not less than 24 months, is dismissed other than the five valid reasons under s.32K , the dismissed employee may seek an order in the Labour tribunal under s.32N or terminal payments under s.32O. The valid reasons for terminating an employment contract include conduct of the employee, such as persistent lateness and disclosing confidential information. Generally, employers are required to give not less than one month notice to dismiss an employee or offering a sum not less than one month’s wages in lieu of notice unless the employee is under probation. Upon termination, employers are also required to pay outstanding wages, payment in lieu of untaken annual leave and any payments specified under the contract.

To recover any unpaid amount, employees made redundant can proceed to Labour Tribunal according to s.32M of the Employment Ordinance.
